Thank you for your email of 18 October 2012 to Jo Swinson MP, about pub companies.

The Minister receives a large amount of correspondence every day and is unable to
respond to each one personally. I have been asked to reply and I apologise for the
lengthy delay in doing so.

In November 2011, the Government set out a self-regulatory approach for the pub
industry. Since that time, Version 5 of the Industry Framework Code has been agreed
and been made legally binding, an independent advisory service has been set up and
the Pubs Independent Conciliation and Arbitration Service has been established and has
heard its first two cases, finding in favour of the licensee. I have included weblinks to the
independent advisory service and the arbitration service below.

Ministers do recognise that concerns have been raised as to the effectiveness of this
self-regulatory approach. As the Secretary of State has made clear to the Business,
Innovation and Skills (BIS) Select Committee, Ministers are keen to ensure that the
reforms are in place and operating effectively. The Secretary of State has therefore
written to the industry, including both the British Beer and Pub Association (BBPA)
and the Independent Pubs Confederation (IPC), to ask them to report on progress in
implementing these reforms, and will update the BIS Committee further following their
response.

I hope that this reply has clarified the Government’s position regarding this matter.
