The Enterprise Act 2002 removed Ministers from competition decicions, placing them in the hands of the UK competition authorities. The Office of Fair Trading (OFT) is the primary competition and consumer protection authority, with responsibilities covering the whole economy. Part of their role includes investigating markets for instance, the brewery trade, and, if it suspects them of having features, which adversely affect competition, will refer them to the Competition Commission for further investigation. Your Constituent should be aware that this market was last considered in July 2005 when the OFT announced that it would not initiate such an investigation, commenting that "The market for the supply of beer has been extensively examined in recent years by the OFT and the CC. It has been found to be broadly competitive and in the process of development."
