Brian Jacob's point is the VERY SIMPLE SOLUTION and must be reiterated:

REMOVE THE TIE. If ther is no tie you don't need all of the crazy shenanigans in place to police the inevitable outcome of its abuse if it's left in place in any shape or form.

The tie is redundant. There should be no issues for small brewers who don't abuse the power the tie gives them because they will have willing partners running their pubs for them and there's nothing preventing voluntary binding supply agreements been drawn up between landlords and tenants. Like a pre nuptual agreement - 'I won't abuse you and take you to the cleaners and neither will you me'...
